A 59-year-old man passed away today from injuries sustained in a pit bull mauling at his Modesto home. Four dogs attacked the man along with his 77-year-old mother on Tuesday, October 14th. His mother remains in critical condition.
The animals belonging to a next-door neighbor got into the victims’ yard through a shared fence. Stanislaus County Sheriffs have not yet said whether they will charge the animal owners with any crime.
All four dogs remained aggressive when deputies arrived at the scene following a 9-1-1 call.
Although in a criminal case a history of biting may be necessary to press charges, that is not how it works in a California civil case. It is an owner’s responsibility to curb their animal, regardless of the dog’s history. If you sustain injuries from a dog bite, the dog’s owner is be responsible for covering your medical expenses as well as scar revision or pain and suffering.
