San Diego side walks are being deemed unsafe for strollers, joggers, cyclists, and skateboarders due to uneven pavement, which can cause major slip and fall accidents and major injuries.
The city is debating how to share the responsibility for the sidewalk construction. The San Diego City Council policy 200-12 have the homeowners and landlords sharing the cost of for any side walk slip and falls with the city.
However the policy is not a formal law so now a council committee is seeking new potential options.
Cities in Northern California like San Jose and Sacramento the city governments disclaim any legal responsibility if residents have any slip and fall injuries.
Nevertheless, the uneven sidewalks in San Diego create a hazardous environment and are nothing near “user-friendly.”
Long-time San Diego residents claim that sidewalk construction is completely necessary as they are progressively getting worse especially around schools where children can slip and fall and possibly sustaining major injuries.
City Hall has been debating this issue for quite some time and there has been a plan presented by a UCLA professor who has covered city infrastructure issues. The plan would be for homeowners to be responsible for their portion of the sidewalk, so if homeowners are selling their homes they must insure the sidewalks are not upheaving.
Unfortunately, this would make it more difficult for homeowners to sell their home or even want to buy a house in San Diego.
There are other options that the city council will discuss for sidewalk construction in order to reduce the number of slip and fall accidents.
This will be the first ever evaluation of sidewalk construction and the results of a $1 million assessment.
Slip and fall accidents can occur anywhere, but if slip and fall accidents happen on city sidewalks it can becomes a public entity case which means there are statutes involved and the case may become more complex.
If you have been injured in a slip and fall accident because of uneven sidewalk it is important to contact a reputable personal injury lawyer. Each city has different regulations in regards to slip and fall accidents so trying handle the case by yourself may complicate things even more.
